UK CMA's Google opt-out rule gives publishers a checkbox, not a remedy. The asymmetry stays intact — here's why the ruling's framing doesn't match its output.
The UK Competition and Markets Authority has imposed a conduct rule requiring Google to let website owners opt out of AI Overviews and prevent their content from being used to fine-tune Google's AI models. The CMA called it a "world first" — regulatory self-congratulation is its own genre; file that phrase and move on.
What was actually produced: a binary toggle. Not a revenue-share framework, not a licensing structure, not a structural remedy. Publishers can flip a switch. That is the complete output of the ruling.
The asymmetry it's meant to address remains intact. Google ingests publisher content, renders summarized value inside its own perimeter, and reduces the traffic that used to flow outward. AI Overviews is the feature working exactly as designed. The CMA isn't touching the design — it's offering an ejector seat. The seat leads directly to reduced visibility on the dominant search discovery surface. "Opt out" in this context is closer to accepting obscurity than exercising leverage.
The CMA's framing — "effective tools," "stronger position to negotiate" — is regulatory PR. Same hollow structure as marketing language: named, moved on. Intent doesn't determine effect, and the effect here is a conduct rule that produces negotiating posture, not negotiating parity. Whether any actual power redistribution follows is an open empirical question with a current evidence count of zero.
